1. INTRODUCTION

0800 Reverse ("0800 Reverse") has elected to supply all its Services to users and customers by way of these standard terms and conditions of agreement (the "Standard Terms and Conditions"). A current version of the Terms and Conditions, together with a summary thereof (the "Summary"), is available on our website www.0800reverse.co.uk or may be obtained by contacting the 0800 Reverse Customer Service Centre on 0845–0779000 or via email at [email protected]. Copies in large print form or a language other than English are also available upon request. 0800 Reverse may vary the Terms and Conditions at any time without notice. The applicable version is the version published on our website or available from our Customer Service as at the date of the Call.

2. OUR SERVICE

0800 Reverse provides a number of Services which are accessible by either the National or International Numbers. The Services are described below.

2.1 National Reverse Charge Service

0800 Reverse provides the ability to receive reverse charge Calls and reverse charge messages as follows:

2.1.1 a person (the "Calling Party") calls the Service using a designated number (the National Number if calling from within the United Kingdom or the applicable International Number if calling from outside United Kingdom) from a Standard Telephone Service, or a payphone service or most mobile services (the "Access Service") and requests the Service to connect a Call from the Access Service to a specified telephone number (the "Specified Number");

2.1.2 0800 Reverse may in its absolute discretion accept the request and attempt to connect the Call;

2.1.3 you or the person answering the Call (the "Answering Party"), on a particular Fixed Service or a Cellular Mobile Service (the "Answering Service"), are asked by 0800 Reverse whether the Answering Party wishes to accept the Call;

2.1.4 if the Answering Service is a Fixed Service and the Answering Party agrees to accept the Call, 0800 Reverse may make the connection between the Access Service and the Answering Service;

2.1.4.1 in circumstances where a connection is not possible, the Calling Party may be given the option, at 0800 Reverse’s absolute discretion to record a message with 1800 Reverse for future delivery to the Specified Number or to request a different Specified Number;

2.1.4.2 should the Calling Party elect to record a message, 0800 Reverse may, in its absolute discretion, use its reasonable endeavours to deliver the message to the Specified Number. It is O800 Reverse’s usual practice to attempt to deliver a recorded message to a Specified Number a number of times between the hours of 6:00 am – 11:00 pm. 0800 Reverse has absolute discretion regarding the number of delivery attempts and the interval between delivery attempts.

2.1.5 if the Answering Service is a Cellular Mobile Service and the Answering Party accepts the Call, 0800 Reverse may make the connection between the Access Service and the Answering Service and:

2.1.5.1 during the call, or up to 60 days after the call (or another period specified by PhonePay Plus), the Service will send a text message/s to the Specified Number for each Call Block which will charge the Connection Charges and the Call Charges to the Answering Service ("Premium Rate SMS");

2.1.5.2 during the call, if the Answering Service has insufficient credit remaining on its Cellular Mobile Service account, the Call may terminate without warning.

2.2 International Inbound Reverse Charge Service

Callers from Australia, Canada, NZ, the USA and the majority of Europe and Asia may make a reverse charge call to most Standard Telephone Services in the United Kingdom by dialling the applicable International access number. A full list of the International Numbers including alternate numbers, are set out in Appendix 2. The process for initiating and completing an International Reverse Charge Inbound Call is similar to that for the National Reverse Charge Service as set out in clauses 2.1 above.

2.3 International Outbound Reverse Charge Service

0800 Reverse offers access to international outbound reverse charge calls from most Standard Telephone Services in the United Kingdom to certain fixed lined telephones in certain foreign countries. To access this Service, a calling party dials the National Number and requests the operator to make a reverse charge call to a requested international number. Such requests are generally handled by an International Operator and the calls are terminated on and charged by the Call Recipient's Service Provider in the applicable country.

2.4 Credit Card Calling Service

A Caller may elect to make an international call outbound from or inbound to the United Kingdom by charging the call charges to the Caller´s Credit Card. The Country access numbers for such calls are set out in Appendix 2. The Credit Card service is outsourced to and provided by BBG Limited or its affiliated companies ("BBG") (see contact details in section 7 below).

3. CALL CHARGES

3.1 For National and International Inbound Reverse Charge Service

3.1.1 The Call Charges applicable for use of our National Reverse Charge Calling Service and our International Inbound Reverse Charge Service are set out in Appendix 1. 0800 Reverse may vary the call charges from time to time in its absolute discretion. The Call Charges notified to you on the website or accessible via our Customer Service as at the date of the Call is the applicable charge. 0800 Reverse will not back date any changes in price.

3.1.2 0800 Reverse does not charge the Calling Party. Carrier charges and/or surcharges from hotels, mobile phones and payphones may however apply to the Calling Party.

3.1.3 You must pay the Call Charges for the provision of the Service. Call Charges will apply from the time when the Answering Party accepts the Call and will continue until such time as the Call is terminated. Alternatively, in the event you receive a message as referred to in section 2.1.4, Call Charges will apply from the time that the Answering Party accepts the message.

3.1.4 0800 Reverse's records are sufficient evidence of the amount payable by you unless they are shown to be incorrect.

3.2 For International Outbound Reverse Charge Service

0800 Reverse does not charge the Call Recipient or Calling Party for the International Outbound Service. Carrier charges and/or surcharges from hotels, mobile phones and payphones may however apply. Call charges incurred by the Call Recipient will be calculated and billed to the Call Recipient by the applicable local telecommunications carrier and are payable by the Call Recipient in accordance with that carrier's standard billing procedures.All enquiries relating to the International Outbound Service, including those relating to pricing and billing, or customer complaints should be directed to the Call Recipient's local carrier.

3.3 Credit Card Calling

Charges for calls made by Credit Card are set, and varied from time to time, by BBG. For information on charges applicable to Credit Card calls, please contact BBG on 0800 2655328 from within the United Kingdom, or by calling the country specific international operator from other Countries, or emailing: [email protected].

The person contractually responsible for the Credit Card used to pay for the Credit Card calling service (the "Credit Card Holder") is responsible for paying the charges in accordance with the terms of their Credit Card statement and underlying contract.

4. BILLING

4.1 For National and International Inbound Reverse Charge Service

4.1.1 BT or your provider of Electronic Communications Services may provide billing services to 0800 Reverse for Calls connected using the Service and for messages accepted using the Service. Where the Answering Service for a Call is a pre-pay Cellular Mobile Service, the Call Charges will be deducted from the available credit on the receipt of the Premium Rate SMS. For calls to Fixed lines where BT is not the provider of Your Electronic Communications Services, the Call Charges in Appendix 1 – Call Charges may vary and you should check with Your Service Provider.

4.1.2 BT or your provider of Electronic Communications Services may print on your bill the phone number of the Calling Party. The Calling Party acknowledges and agrees to the number of the Standard Telephone Service or payphone the Calling Party is calling from being printed on the bill and agrees to use the Service on this basis.

4.1.3 The Call Charges will be billed to you and payable by you within the times required by BT or your provider of Electronic Communications in accordance with their standard billing procedures.

4.1.4 BT or your provider of Electronic Communications Services is not responsible for any enquiries in relation to our Service.

4.1.5 All enquiries, including those relating to pricing and billing, or customer complaints should be directed to the 0800 Reverse Customer Service Centre on 0845-0779000. The opening hours for the 0800 Reverse Customer Service Centre are Monday to Friday 9:00am - 5:00 pm excluding public holidays.

4.2 For International Outbound and Credit Card Calling

Billing for International Outbound Calls is the responsibility of the Call Recipient's telecommunications carrier. For Credit Card calling, billing is handled by the Credit Card provider and in accordance with the applicable contract between the Credit Card provider and the Credit Card Holder.

5. VALUE ADDED TAX ("VAT")

5.1 If Value Added Tax ("VAT") is imposed on any supply made by 0800 Reverse pursuant to these Standard Terms and Conditions, you must pay, in addition to any consideration payable, or to be provided by you under these Standard Terms and Conditions for the supply, an additional amount calculated by multiplying the prevailing VAT rate by the consideration for the relevant supply payable, or to be provided, by you under any other clause in these Standard Terms and Conditions.

5.2 In these Standard Terms and Conditions, two amounts will be displayed for all Call Charges where VAT is applicable:

5.2.1 The first is the Call Charge without VAT. This Call Charge will be used to calculate the individual items listed on your bill; and

5.2.2 The second is the indicative Call Charge including the VAT. This Call Charge is not used in the calculation of total charges but is displayed here to give an indication of the charge you may actually pay for individual items when VAT is calculated and added.

5.3 The Call Charges and any other charges payable by you to 0800 Reverse in relation to the Service are generally listed on the bill without VAT. These amounts are generally totalled (or subtotalled) on the bill and the VAT is then calculated and added separately. Due to rounding, differences may arise between the VAT inclusive amount in the Standard Terms and Conditions and the total charges calculated on the bill using the VAT exclusive price plus the prevailing VAT rate.

5.4 Any discounts applicable will be calculated on the charge without the VAT.

5.5 In some cases, advertised prices may be rounded up.

6. YOUR OBLIGATIONS

6.1 You agree to acquire from 0800 Reverse the Services on the terms and conditions set out in this Terms and Conditions. 0800 Reverse agrees to provide the Service to you at its absolute discretion and subject to these terms and conditions.

6.2 You must use, and ensure that third parties use, the Services in accordance with these terms and conditions.

6.3 You are responsible for all applicable charges for use of any Service whether such Calls were accepted by you or another person with or without your knowledge or consent.

6.4 You are responsible for the Calling Party's use of the Service. You will indemnify, and will keep indemnified, 0800 Reverse in relation to the Calling Party's use of the Service and for any other claim made by or on behalf of the Calling Party against 0800 Reverse in relation to the Service including without limitation, to any other claim made by or on behalf of a Calling Party that the Calling Party's call, or any message recorded by the Calling Party, was not accepted by the Answering Service or was not delivered to the Specified Number by the Service or was not connected by the Service. 6.5 If the Service, or associated Services, are suspended or cancelled, you will remain liable for changes and liabilities incurred before the suspension or cancellation.

7. REASONABLE USE POLICY

7.1 You and Your Calling Party must only use Services provided by 0800 Reverse for their intended purpose. Where 0800 Reverse reasonably suspects misuse of the Service by You, any other user associated with You or Your Calling Party, You accept that 0800 Reverse may terminate, suspend or restrict supply of the Service. Behaviour that constitutes Misuse of the Service includes, but is not limited to:-

(i) Your Calling Party using the Service for the purpose of giving a recorded message (instead of a name) to You before You accept any charges; or
(ii) Your Calling Party’s consistent use of the Service to prompt or signal You to call them back; or
(iii) You or Your Calling Party receiving or making an unreasonable number of calls using the Service which do not result in a completed reverse charge call.

You agree that 0800 Reverse may monitor Your use and Your Calling Party’s use of the Service to enforce the misuse policy above, including monitoring of any recordings made using the Service. You also agree that 0800 Reverse reserves the right to vary the terms of this misuse policy from time to time. If the Service, or associated Services, are suspended or cancelled, You will remain liable for charges and liabilities incurred before the suspension or cancellation.

7.2 You must not, and ensure that third parties (including the Calling Party) do not, use the Service to transmit any defamatory, offensive, abusive, indecent, menacing, illegal or hoax material or other material that would otherwise constitute a breach of any duty or obligation owed to 0800 Reverse or any third party. You must also not, and ensure that third parties (including the Calling Party) do not, use the Service to interfere with calls made by any person or tamper with the Service in any way. You indemnify and shall keep indemnified 0800 Reverse against all claims, costs, loss, expenses or injuries arising in relation to a breach of this clause.

7.3 When using any Service, you must comply with, and ensure others comply with, all laws, regulations, codes or determinations or any other requirements of any government or statutory authority.

8. CUSTOMER ENQUIRY AND COMPLAINTS CODE

8.1 All enquiries, complaints and compliments regarding our Services (other than the Credit Card Service) should be directed to the 0800 Reverse Customer Service Centre at:

Upon request, a copy of this code can be provided to you free of charge. If you are unable to complain yourself, you can ask someone to register a complaint and act on your behalf. 0800 Reverse will attempt to resolve all simple queries that are handled by telephone whilst the customer is on the line. 0800 Reverse will attempt to resolve other simple queries received via the 0800 Reverse website or via email by close of business on the next business day. 0800 Reverse aims to resolve 90% of complex enquiries within 48 hours of the query being lodged and the remaining 10% 0800 Reverse aims to resolve within 4 business days.

If an agreed settlement has not been reached within eight weeks of receiving your complaint or 0800 Reverse agree in writing before the eight weeks is up that the dispute should be settled by independent adjudication, you have the option of referring your complaint for independent consideration to CISAS (the Communications and Internet Services Adjudication Scheme). 8.2 0800 Reverse at its absolute discretion, may agree to rebate in part or full charges in certain circumstances. Where it agrees to do this, 0800 Reverse may arrange for the appropriate credit to appear on your telephone bill or send you a refund cheque by post.

9. YOUR PERSONAL INFORMATION

9.1 0800 Reverse and its affiliated companies treat all personal information with privacy and respect and in accordance with the law. 10. QUALITY AND AVAILABILITY OF SERVICE

10.1 It is technically impractical to guarantee any Service will be free of fault or error or that there will always be sufficient capacity to connect and carry all Calls or messages attempted using the Service. 0800 Reverse undertakes to provide the Service using the reasonable care and skill of a competent carriage service provider, but may be subject to failure by our suppliers to deliver capacity.

10.2 Apart from some geographical limitations, you also acknowledge that some Services are not available to Fixed Services where the subscriber local loop is owned by a carrier other than BT and to some Cellular Mobile Services and in other limited circumstances. For further information on these circumstances, you may contact the 0800 Reverse Customer Service Centre on 08450779000.

10.3 The Service is not available from all destinations outside the United Kingdom.

10.4 0800 Reverse may suspend or terminate any Service at any time and for any reason without liability to you, the Calling Party or any third party.

10.5 Despite any other provision of these terms and conditions, to the extent permitted by law, 0800 Reverse will not be liable to you, or any person claiming through you, in contract, tort or otherwise (including negligence) for any loss or damage arising from suspension or termination of the Service or any faults arising in any Service.

10.6 0800 Reverse will not be liable to provide the Service to you if it becomes impracticable to do so because of any cause beyond 0800 Reverse's reasonable control, including without limitation acts of God, civil disorder or war, acts of terrorism, international, national or local emergency, adverse weather conditions, accident, industrial dispute, materials or labour shortage, outages in telecommunications networks, law or regulation, or acts or omissions of other carriers or providers of Electronic Communications Services or any other authority or third person.

11. LIMITATION OF LIABILITY

11.1 You use the Services at your sole risk. 0800 Reverse does not warrant that any Service will be uninterrupted or error-free.

11.2 To the extent permitted by law 0800 Reverse excludes all liability to you or any other person claiming through you for any cost, loss, liability or damage arising (whether in contract, tort, under statute or otherwise) out of 0800 Reverse's performance or failure to perform or delay in performing its obligations (including as a result of negligence) under these terms and conditions including, but not limited to, liability:

11.2.1 for any economic, indirect or consequential loss (including but not limited to any loss of profits or loss of business); or

11.2.2 arising from the acts or omissions of any carrier or carriage service provider other than 0800 Reverse, or from failure of, or default in any other service, other networks, facilities or equipment of any carrier or provider of Electronic Communications Services comprised in the Service.

11.3 To the extent that 0800 Reverse does have some liability to you at law which cannot be excluded, the total liability of 0800 Reverse to you or any person claiming through you for any cost, loss, liability or damage arising out of the failure of any Service due to 0800 Reverse's performance of, or failure to perform, its obligations under these Terms and Conditions and including as a result of any act or omission of 0800 Reverse, whether in contract, tort, statute or otherwise, is limited, to the extent permitted by law, at 0800 Reverse's option to:

11.3.1 in the case of goods, repairing or replacing the goods, or supplying equivalent goods, or paying the cost of doing any of these; or

11.3.2 in the case of services, supplying the services again or paying the cost of doing so.

You indemnify and shall keep indemnified 0800 Reverse against any cost, loss, liability or damage arising (whether in contract, tort, under statute or otherwise) directly or indirectly, as a result of or in connection with the actions or omissions of any other person in relation to use of any Service with or without your knowledge or consent.

11.4 If you breach this Terms and Conditions, you are liable to 0800 Reverse for its costs (including all legal costs) in exercising its rights in relation to the breach.

12. MISCELLANEOUS

12.1 A person who is not a party to these Standard Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Standard Terms and Conditions but this does not affect any right or remedy of a third party which exists or is otherwise available apart from that Act.

12.2 0800 Reverse may vary or cancel the Terms and Conditions in accordance with relevant telecommunications laws.

12.3 If any of part of these terms and conditions is void or unenforceable, they are taken to be removed and no longer form part of this Terms and Conditions. The remaining terms and conditions will continue in full force and effect.

12.4 Cancellation of any Service does not affect the provisions in the Terms and Conditions regarding limitation of liability and indemnity.

12.5 These Terms and Conditions contains your and 0800 Reverse's entire understanding and agreement relating to the Services.

12.6 These Terms and Conditions is governed by and construed in accordance with the laws of England.

13. DEFINITIONS

Defined terms used throughout this SFOA have the following meanings:

0800 Reverse
means 0800 Reverse Pty Ltd (ACN 102 312 443) of 23 McDougall Street Milton Qld Australia 4064

Access Service
has the meaning as set out in clause 2.1.

Answering Party
has the meaning as set out in clause 2.1.

Answering Service
has the meaning as set out in clause 2.1.

Call
means a telephone call made using the Service and includes messages made and accepted using the Service.

Call Charges
are the charges applicable for a Call, as provided for in Appendix 1.

Charge Cap
means the maximum charge for a Call as described in Appendix 1.

Calling Party
has the meaning as set out clause 2.1.

Call Rate
is the timed rate at which a Call is charged. The Call Rate is fixed per Call Block and is dependent on the time of day on which the call is made, whether the Call is classified as a call originating from an ordinary line, a payphone, a Mobile Originated Call, a Mobile Terminated Call or an International Inbound Call.

Connection Charge
means the fixed charge payable for connection of a Call and is further described in Appendix 1.

Country/ies
means those countries (excluding the United Kingdom) from which 0800 Reverse can supply the Reverse Charge Service, including those countries listed in the table in Appendix 2 and via the corresponding telephone numbers listed in the same table in Appendix 2. 0800 Reverse may at any time vary those countries from which the Service can be accessed and those corresponding telephone numbers. Credit Card means the following credit cards: Visa card, MasterCard, American Express and Diners Club.

Credit Card Holder
has the meaning provided in clause 3.3.

Duration Cap
means the maximum length of a Call between connection and disconnection of a Call as described in Appendix 1.

Electronic Communications Network
means:
(a) a transmission system for the conveyance, by the use of electrical, magnetic or electro-magnetic energy, of Signals of any description;
(b) such of the following as are used, by the person providing the system and in association with it, for the purpose of conveyance of the Signals.
  i. Apparatus comprised in the System;
  ii. Apparatus used for the switching or routing of the Signals; and
  iii. Software and stored data.

Electronic Communications Services
means any service consisting in, or having as its principal feature, the conveyance by means of an Electronic Communications Network of Signals, except in so far as it is a Content Service.

Fixed Service
means a Standard Telephone Service operating within the United Kingdom that is not a cellular mobile service.

Cellular Mobile Service
means a public cellular mobile telecommunications service provided in the United Kingdom by any cellular provider who are providers of Electronic Communications Services. To avoid doubt, each of (i) a cellular mobile service connected in the United Kingdom but not located in the United Kingdom at the time a Call is made; and (ii) a cellular mobile service connected outside the United Kingdom but located in the United Kingdom at the time a Call is made, is a Cellular Mobile Service for this definition.

International Inbound Call
means a Call made from an Access Service located in a Country and to an Answering Service in the United Kingdom.

International Outbound Call
means a Call made from an Access Service in the United Kingdom to an Answering Service in a Country.

International Number
means the relevant telephone number that provides access to the Service from a Country. 0800 Reverse may at any time vary those countries from which the Service can be accessed and those corresponding telephone numbers.

National Number
means the following telephone number 0800 738 3773, which has the alpha-numeric translation

"0800REVERSE" Service(s)
means the service or services described in clause 2.

Specified Number
has the meaning as set out in clause 2.1.

Standard Telephone Service
means the provision to end-users at fixed locations of a service for the originating and receiving of national and international calls including voice telephony services and includes standard telephone services in the United Kingdom.

Timed Charge
has the meaning as set out in Appendix 1.

14. APPENDIX 1 - CALL CHARGES

Call Charges for National Reverse Charge Calls to Fixed Services Charges for Calls made through the 0800 Reverse National Reverse Charge Calling Service to Fixed Services are made up of the following two components:

(a) a Call Connection Charge, which is a fixed amount for each Call; and
(b) a Call Charge based on the type of line from which the Call was made and the duration of the Call.
Unless otherwise stated, there is a maximum Call duration cap of 45 minutes.
A message charge applies for accepting a message delivered by 0800 REVERSE which is a fixed amount for each message.

The called person must agree to pay for the call before it is connected.

These prices only apply to calls to BT numbers, not to non BT lines, or numbers in the Channel Islands or the Isle of Man.

The 0800 REVERSE service is listed in the BT Price List as the `service' provided, is delivered to and paid for by BT customers but BT is not the provider of the service.

0800 REVERSE is a service which uses an 0800 number as the point of entry for callers. This Price List entry lists the price for the `service' not the price that is associated with the 0800 calls the charges associated with the 0800 call are paid by the service provider. The charges for the `service' are paid by the party that receives the `service' calls.

16. TERMS AND CONDITIONS FOR GENERAL COMPETITIONS


These are the General Competition Rules that govern the relationship between you and us when you enter one of our competitions in the absence of any specific terms and conditions in relation to a competition ("Competition(s)"). By participating in any of our Competitions, you agree to be bound by these General Competition Rules (which may be amended or varied at any time by us with or without notice) in the absence of any specific terms and conditions and by our decisions, which are final in all matters relating to the Competitions.

When entering a competition, you should follow any links on the competition entry page of our website to the specific terms and conditions for that particular competition which would apply instead of these General Competition Rules.

There are additional terms that apply to your use of our services and websites. Please follow the links to read those terms. You should also read our Privacy Policy which applies to all of your dealings with us and explains what use we will make of any personal information you may give us as a user of the 0800 Reverse service or a visitor of the website. See data protection section 7 below which applies to all your dealings with us and explains what use we will make of any personal information you may give us as a competition entrant.

16.1 Our Details

"We&, "us" and "our" means 0800 Reverse Pty Limited. Our VAT number is 863 4959 78. If you have any questions or concerns please refer to our frequently answered questions (FAQ’s). If the FAQs do not adequately address your questions or concerns you may contact us using our email contact form.

16.2 Changes To These Terms

We may need to make changes to these terms in future, for example, to reflect changes in the type and/or format of competitions that we run or to correct errors in these terms. We will try to keep all such changes to a minimum. We recommend that you check these terms from time to time to see if they have changed. We will always state at the bottom of these terms the date on which they were last updated.

16.3 Mechanics for entry

(i) Costs to enter the competition will depend on the method of entry and you should seek the permission of the person paying the bill before entering. The cost to enter via the Internet may vary so please check with your network operator for current charges. If entering by telephone Calls on a standard telephone line will depend on your landline provider costs may vary so please check with your provider for current charges. Mobile phone rates may also vary so entrants should check with their local mobile network service provider for current call charges. If entering by way of premium rate SMS you will be charged a fee for such entry which we shall notify to you which will be in addition to the standard messaging costs charged by your network operator (which should be checked with your network operator) and you will advised of Mobile Terms of Use for further details on how you are charged for premium rate SMS services. If entering by post you shall be responsible for paying sufficient postage on your entry.

(ii) The start and closing date for any Competition shall be set out on the Competition entry page and/or the Competition on-air television promo (if any).

(iii) You may only enter a Competition if you are a resident of the UK (unless other territories are also specified on the Competition entry page in which case residents of such territories may also enter) and you are aged thirteen (16) and over (unless a higher age limit is specified on the Competition entry page in which case that will apply and we reserve the right to implement age requirements where necessary). If you are under thirteen you must have your parents consent to enter and tick the applicable box to confirm this is the case.

(iv) You may not enter a Competition if you are an employee or immediate relatives of any employees of 0800 Reverse Pty Limited and its affiliated companies or of any Competition sponsors, Prize providers, co-promoters or their group or affiliate companies or any other person professionally connected with the Competition.

(v) You may provide multiple entries to the competition, which must include the information requested on the Competition entry page which may include your name, age, e-mail address, postal address, telephone number of entrant and/or answer to the question.

(vi) The winner(s) will have answered the question correctly and will be the first entry/entries randomly drawn on the date of the Prize draw from all correct entries received.

(vii) The winner(s) will be notified by e-mail or telephone as soon as possible after the Competition draw and may receive subsequent written confirmation and full details of the Prize.

(vi) In the event that we cannot for any reason contact the winner within a reasonable period of time from the Prize draw, we reserve the right to draw another winner.

(vii) Our decision is final with respect to any aspect of the competition, including the determination of any winner(s) of a Prize and no correspondence will be entered into.

(viii) The names of the winner(s) can be obtained by emailing [email protected] (specifying the Competition) for one (1) month after the Competition closes.

16.4 Prizes

(i) The Competition Prize shall be set out on the Competition entry page and/or the Competition on-air television promo (if any) (“Prize”) and if the winner(s) is allowed to bring any guests the number of guests will also be set out on the Competition entry page (“Allowed Guests”).

(ii) The receipt, by any winner(s), of any of the Prize components is conditional upon compliance by the winner with any and all relevant laws, rules and regulations as well as these General Competition Rules. The winner(s) and any Allowed Guests are solely responsible for all insurance, applicable taxes and for any expenses or costs not specified in the Prize description.

(iii) Where Prizes involve the winner(s) travelling, the winner(s) and any Allowed Guest(s) shall be required to hold a valid passport and/or other necessary travel documentation and visas.

(iv) Where Prizes necessitate travel on a specific date, the winner(s) and any Allowed Guest(s) must be able to travel on the date specified by us and no alternative dates will be available. If the winner(s) is able to choose the date of travel the trip must be taken within twelve (12) months of the closing date of the Competition, excluding travel on or around public holidays both in the UK and the Prize destination. The exact dates for travel shall remain subject to availability.

(v) Travel insurance shall not be included in any Prize so the winner(s) and any Allowed Guest(s) are advised to obtain their own travel insurance.

(vi) Where the winner(s) is under eighteen (18), any Allowed Guest(s) must include a parent or legal guardian. Where the winner(s) is under eighteen (18) and in full or part time education and the Prize necessitates travel on a date that is in school term-time, the winner(s) must obtain the prior written consent of his/her head-teacher and his/her parent or legal guardian for the winner's absence from school on that day.

(vii) The winner(s) may be required to provide a written acknowledgement of acceptance of all terms and conditions of the Competition but in respect of winner(s) under the age of eighteen (18) all Prizes are subject to the applicable winner(s) first printing off these General Competition Rules, obtaining the relevant signatures from their parents or legal guardian and emailing the ng the signed document to 0800 Reverse Pty Limited at [email protected] or by fax to 0207 591 2277 (specifying the Competition).

(viii) All Prizes are non-transferable and no cash alternative will be offered. Arrangements for the fulfillment of Prizes will be made by us. If due to circumstances beyond our control we are unable to provide any stated Prize(s), we reserve the right to award a substitute Prize of equal value. All Prizes are subject to the additional terms and conditions of the manufacturer or supplier.

(ix) The winner(s) agree that 0800 Reverse Pty Limited, their subsidiaries, affiliates, related companies and employees, and any other sponsors and Prize providers shall have no liability in connection with acceptance or use of any of the Prizes awarded in the Competitions. We reserve the right to disqualify any entrant and/or winner at our absolute discretion.

16.5 License For Material Submitted By You Or Footage Filmed Of You

In exchange for allowing you to enter the Competition, you hereby:

  • grant to us a non-exclusive worldwide, sub-licensable licence to use, or allow third parties to use, any material you have provided to us in connection with the Competition including photos, artwork, written text, videos and images (“Material”) in any manner we choose on any media (existing now or in the future) without restriction for the full term of any rights that may exist in your Material (without payment to you or any third party). You still own your material and may use it as you wish but we have the right to use it for example by showing your Material to the general public on our television channels or to publish/stream it on our websites or to provide it to our distribution partners to show it on their television channels or websites. We may require you to provide us with a written acknowledgement of this licence by printing off and signing these General Competition Rules

     

  • grant us the exclusive right to film, tape, sound record and photograph all your activities in connection with the Competition and (if applicable) any Prizes. Everything filmed, taped or recorded of you by the Promoter shall be known as "Footage".

  • assign to us fully all intellectual property rights in any Footage throughout the world for the full term of any rights that may exist under any applicable law throughout the world. This means that we own all rights in the Footage for as long as they exist. We may require you to sign a release form consenting to the filming/recording of the Footage, the assignment of all rights in such Footage to us.

  • waive any “moral” rights that you may have in your Material or the Footage for the purposes of us using it in accordance with these General Competition Rules. Your moral rights include the right to be identified as the author and the right to object to derogatory treatment of your Material or the Footage. We need this waiver because we may not always be able to identify you (or other users who have uploaded content) as the author, and we need to be able to edit or treat your material as we see appropriate in our editorial judgment.

     

  • agree that we may use your, name and/or likeness, voice, photographs and/or video footage of you, biographical information provided by you and/or any statement made by you concerning the Competition and/or the Prize(s) in connection with publicizing the Competition, in any and all media in perpetuity throughout the world in any manner we choose without restriction.


Terminating the licence in your Material

If you want us to stop using your Material please tell us submit the details of your material along with your instruction to remove this material using our email contact form. We will then stop using your material in new programming on our services as far as reasonably practicable.


Your promises

It is very important that the Material you provide as part of a Competition is your own work. Material that you did not create yourself, or that include images of people or information about people without their permission can result in serious liability to us and to you.

Accordingly, you promise that:

  • You are the only creator, author and owner of the Material you post or upload, or if you are not the exclusive owner you have received written consent from the owner to upload or post the Material and to grant us the rights to use the Material as set out above.

  • The Material will not contain anything that is defamatory, offensive or illegal.

  • Your Material is free from any right or claim by anyone under any recording contract, publishing contract, or any union, guild or collecting society such as the Performing Right Society and you agree that you will inform us immediately if this status changes.

  • Our use of your Material will not infringe any intellectual property or other rights of any third party (for example trade marks, copyright, privacy rights). This means that, if your Material contain any underlying copyrights such as music, lyrics, film footage, artwork or other copyright material owned by any other person, you confirm that you have obtained all necessary consents in writing (including from other people appearing in your Material) necessary for us to use your material as set out above.


 

16.6 Liabilities

(i) We can accept no responsibility for entries lost, delayed, misdirected, damaged or undelivered. Incomplete and/or illegible entries will be disqualified. We shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition.

(ii) We will not be liable to you (whether as a result of contract law, tort, and statutory duty or otherwise) for any loss or damage arising out of or in connection with a Competition in respect of losses:

  • that are related to a business or commercial undertaking

  • that were unforeseeable

  • that are related to loss of opportunity, loss of goodwill or injury to reputation

  • that are suffered by third parties

  • that are caused by loss of data, or computer virus

  • in respect of infringement of rights arising as a result of a third party linking to our online services and causing our content to be viewed within the pages of any other website

  • that are due to your fault, for example if you have provided incorrect information to us or you fail to comply with our instructions in relation to the Competition and/or Prize

  • that are not caused by our breach

(iii) If you have a claim against another provider of services in connection with the Competition and/or Prizes you will pursue that claim independently and without recourse to us.

(iv) We do not in any way seek to limit or exclude our liability to you for death or personal injury or any loss arising as a result of fraud.

(v) We shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winner(s) and/or any Allowed Guests and/or parent(s)/legal guardian(s) under these General Competition Rules if such delay or failure is caused by circumstances beyond our reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or arising without limitation out of or in connection with:

  • the activities of third party event organisers;

  • any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars); and/or

  • by third parties providing accommodation included in the Prize.

For the avoidance of doubt, the affected Winner(s) and/or any Allowed Guest(s) and/or parent(s)/legal guardian(s) shall be solely liable for any additional costs incurred as a result.


16.7 Data Protection

Any personal information, including without limitation, the your name, age, address (including postcode), telephone number and/or email address ("Personal Data") will be used (i) in connection with the Competition which you entered, (ii) for any purpose to which you gave your express consent on entry (iii) as set out in these General Competition Rules and (iv) in accordance with our Privacy Policy (click for more details on how we deal with your Personal Data). Your Personal Data will not be disclosed to any third party, except for the purpose of fulfilling the Prize(s) where applicable unless you gave your express consent to this on entry.

Personal information

As a competition entrant 0800 Reverse may collect personal information about you if it is volunteered by you. 0800 Reverse will only use competition entries information for email marketing and SMS marketing to advise of future competitions and news items with clear provision for opt out of receipts from future marketing campaigns. Entry to competitions will serve as opt in to receive email marketing and SMS marketing to inform of new competitions and news items. Otherwise, Reverse Corp does not collect personal information about you through our websites.

Nonpersonal information

Reverse Corp may collect nonpersonal information from you when you use our websites. For example, we might track information about the date and time you access one of our websites, the type of web browser you use, and the website from which you connected to our site. Our websites collect this information by depositing "cookies" in your computer. This technology does not collect information which personally identifies you. Rather, this information is collected in an aggregate form. The cookies can tell us how and when pages in a website were visited and by how many people. This aggregate information enables us to improve our websites to serve and inform you better. It also may allow you to shortcut access to points of interest on our website when you reenter our system.

Reverse Corpdoes not match any personal information we have collected about you with the anonymous information described above. In general, Reverse Corp only uses cookies for security purposes and to assess the usage and to improve the functionality of our website. You may set your computer so that cookies are not placed on your system, however, disabling cookies may result in some reduction in the functionality and ease of use of this site.


16.8 Jurisdiction

These General Competition Rules shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom.
